A Guide to Responding to Breaches

Planning Enforcement Overview

Planning policy encourages the planners to enforce unauthorised development in accordance with planning law. For less serious breaches you are often required to submit a planning application within a timeframe to the local planning authority.

Planning Contravention Notice (PCN)

A Planning Contravention Notice is a precursor to an Enforcement Notice, and is subject to timescales requiring answers to questions on dates, ownership, use, that should be responded to.

Enforcement Notice Deadlines

If you receive and Enforcement  Notice beware,  you are on a strict timetable and   you need   to appeal usually within 28 days, or the notice takes effect.

Risks of Unauthorised Development

You can build what you like. Until you receive an Enforcement Notice you have not broken the law, but the final  outcome may be, following a failed appeal , that you are required to demolish what you have built.
